Terms of Service

1. Acceptance of Terms

By connecting your wallet to xrphasnfts.com ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. Your continued use of the Platform after any updates to these Terms constitutes acceptance of those changes.

2. Eligibility

The Platform is open to users of all ages for general content. However, certain content on the Platform may be marked as adult or age-restricted (18+) by profile owners. To access age-restricted content, you must verify that you are at least 18 years old or the age of majority in your jurisdiction, whichever is greater. You are responsible for complying with your local laws regarding age requirements for viewing adult content.

3. User Accounts

Authentication on the Platform is wallet-based. You connect using an XRP Ledger (XRPL) wallet through supported wallet providers (Xaman, GemWallet, Crossmark, or WalletConnect). You are solely responsible for the security of your wallet and private keys. We do not store passwords or private keys.

Usernames and vanity URLs must be 4–15 characters, consisting of letters, numbers, and underscores. They cannot start or end with an underscore, and must not contain profanity, impersonate others, or infringe on trademarks. We reserve the right to reclaim or reassign usernames and vanity URLs at our discretion.

4. User Content & NFTs

The Platform displays NFT metadata from the XRP Ledger. We do not host, store, or control the NFTs themselves or their underlying media. Users are solely responsible for the NFTs they hold and display on their profiles. The Platform makes no representations or warranties about the content, legality, or authenticity of any NFT.

By displaying NFTs on your profile, you represent that you have the right to display them and that doing so does not violate any third-party rights or applicable law.

5. Adult / NSFW Content Policy

The Platform allows users to mark their profiles as containing 18+ / adult content. This system operates on a self-certification basis:

• Users who mark their profile as 18+ represent and warrant that they are of legal age in their jurisdiction to create or distribute such content.
• Users who enable viewing of 18+ content represent and warrant that they are of legal age in their jurisdiction to view adult material.
• The Platform relies on user self-certification of age. We do not perform independent identity or age verification beyond the date-of-birth check provided.
• The Platform is not responsible for verifying the actual age of any user.
• Users agree to indemnify and hold the Platform harmless from any claims, damages, or liabilities arising from age misrepresentation or the viewing or distribution of age-restricted content.

18+ profiles are completely hidden (not blurred) from users who have not verified their age and opted in. They are also excluded from public leaderboards and search results for non-opted-in users.

6. Pro Subscription

The Platform offers a Pro subscription with enhanced features. Key terms:

• Pricing: Subscription payments are made in XRP on the XRP Ledger. Current pricing is listed on the upgrade page.
• Plans: Monthly, annual, and lifetime options are available.
• Non-refundable: All payments in XRP are final and non-refundable due to the nature of blockchain transactions.
• Renewals: Time-based subscriptions (monthly/annual) must be renewed before expiry. A 24-hour grace period is provided after expiration before Pro features are revoked.
• Feature revocation: Upon expiration (after the grace period), Pro features (vanity URLs, extended NFT display, etc.) will be disabled until renewed.

7. Prohibited Content

Even with the adult content system in place, the following content is strictly prohibited on the Platform under all circumstances:

• Child sexual abuse material (CSAM): Zero tolerance. Any account found displaying, promoting, or linking to CSAM will be immediately and permanently banned, and reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.
• Any content that sexualizes or depicts minors in any capacity.
• Non-consensual intimate imagery ("revenge porn") or content depicting non-consensual acts.
• Content that promotes terrorism, violence, or illegal activities.
• Content that violates applicable laws in the United States or the user's jurisdiction.

8. Intellectual Property

NFTs displayed on the Platform are subject to their own intellectual property rights as determined by their creators and the terms under which they were minted. The Platform makes no claims on the ownership, copyright, or licensing of any NFT displayed by users.

The xrphasnfts brand, logo, and platform design are the intellectual property of xrphasnfts. You may not use our branding without prior written permission.

9. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We are not responsible for:

• Fluctuations in the value of XRP or any cryptocurrency.
• XRP Ledger downtime, network congestion, or failed transactions.
• Wallet security breaches, lost private keys, or unauthorized access to your wallet.
• The accuracy, legality, or appropriateness of NFT content displayed by users.
• Any loss of funds, data, or digital assets arising from the use of the Platform.

To the maximum extent permitted by law, our total liability for any claim arising from or related to the Platform shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy. Key points:

• Wallet addresses are public by nature on the XRPL. Connecting your wallet to the Platform means your address and on-chain NFT holdings are visible to other users.
• We store: wallet address, display preferences (username, vanity URL, display settings), subscription status, and age verification data (birth year and month only).
• We do not require or store email addresses, real names, or physical locations unless voluntarily provided by the user.

11. Termination

We reserve the right to suspend or permanently ban any account that violates these Terms, particularly (but not limited to) violations of the Prohibited Content policy. In the event of termination for cause, no refund of subscription fees will be provided.

You may stop using the Platform at any time by simply disconnecting your wallet. Your profile data will remain unless you request deletion.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the use of the Platform shall be resolved in the state or federal courts located in the State of Texas.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. For significant changes, we may display a notice on the Platform.
